Telangana · Power of attorney
Fill the Telangana Registration Department's model special power of attorney for an NRI seller to have a sale deed signed abroad presented and registered.
Sign it before a notary or the Indian consulate where you live, with two witnesses, and send it to your attorney. It must be stamped in Telangana within three months of reaching India.
Check the current fees and documents with the office before you go.
Enter your details, your attorney's, the purchaser's, the date you signed the sale deed, the consideration and the property schedule.
Sign every page in black ink before a notary public or Indian consul where you live, with two witnesses signing the power of attorney.
Send the attested power of attorney with the signed sale deed to your attorney, who pays stamp duty within three months of it reaching India and presents the deed at the SRO.
Under Section 33(1)(c) of the Registration Act, 1908, if you do not live in India the power of attorney must be executed before and authenticated by a notary public, a court, judge or magistrate, an Indian consul or vice-consul, or a representative of the Central Government.
No. The department states that a power which requires attestation will not be accepted if it is registered instead of attested, because this is an incurable defect.
Its instructions ask the executant to sign every page of the sale deed and the power of attorney in black ink, put a left thumb impression and passport-size photograph on the photo form, and send an ID and address proof. Each page is attested by a notary public with seal and signature, and two witnesses sign the power of attorney but not the sale deed.
For a document executed outside India, stamp duty can be paid within three months from the date it is received in India. It is produced before the district registrar, who endorses the payment under Section 18 of the Indian Stamp Act, 1899.
A document executed outside India can be presented within four months after it arrives in India. The person presenting it may have to prove the arrival date, for example with a courier delivery receipt or an affidavit from whoever carried it.
Not with this form. It lets your attorney present a sale deed you have already signed and admit its execution. A general power of attorney that authorises the agent to sign is a different document, and the agent then signs as the executant.
