Online EC covers transactions from 01-01-1983 onwards only. For an earlier period, or if you need an ink-signed encumbrance certificate, the department asks you to approach the sub-registrar office concerned.
According to the Registration and Stamps Department, ECs are issued by MeeSeva centres, sub-registrar offices and district registrar offices. The online search can be used from anywhere at any time.
The form asks for the property's location, door, plot or survey number, extent, the owner's name, boundaries and the period of search, with a separate block for agricultural land. The department notes that ECs are built from the property description given at registration, and that incomplete or inaccurate details in the application can produce a wrong EC.
A nil EC means no registered transactions or liabilities were found for the property described, for the period searched. Unregistered transactions are not included, and the department advises against relying on an EC alone before buying a property or lending money.
Yes. The department says interested parties may approach the sub-registrar and, on paying the prescribed fee, may be permitted to verify the records personally.
The fee is set by the department and is entered by the sub-registrar on the form with a receipt number. The department's EC page does not publish a fee or time limit for applications at the office, so check both with the SRO.
